3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. By using the Service, you represent and warrant that you meet these requirements.

The Service is intended for registered businesses in India, specifically healthcare providers such as clinics, dental practices, physiotherapy centers, skin clinics, and cosmetic clinics.

4. Account Registration and Obligations

To use ClinicCare, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Be responsible for all activities under your account

You agree to notify us immediately of any unauthorized use of your account.

5. WhatsApp Business Requirements

To use the WhatsApp automation features, you must:

  • Have a valid WhatsApp Business account in good standing
  • Comply with WhatsApp's Business and Commerce Policies
  • Obtain necessary consents from patients to receive automated messages
  • Use the Service only for legitimate clinic communications

You acknowledge that we are not affiliated with WhatsApp Meta and that you are solely responsible for your WhatsApp Business account compliance.

6. Acceptable Use

You agree NOT to use the Service to:

  • Send spam, unsolicited messages, or any content that violates anti-spam laws
  • Harass, threaten, or defame any person or entity
  • Violate any applicable laws, regulations, or third-party rights
  • Attempt to gain unauthorized access to our systems or other users' data
  • Use the Service for any illegal or unauthorized purpose
  • Interfere with or disrupt the integrity or performance of the Service

7. Patient Data and Consent

You are solely responsible for:

You agree to indemnify, defend, and hold harmless ClinicCare and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Patient data you process using the Service

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service immediately ceases.

You may cancel your subscription at any time through your account settings. No refunds will be provided for unused subscription time.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in India.

14. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
